The Client acknowledges having read them before subscribing. <\/p>\n<p>EZTrack reserves the right to modify these Terms and Conditions at any time. Modifications will be notified to the Client by email at least 30 days before they take effect. <\/p>\n\n<h2>Article 3 \u2014 Description of services<\/h2>\n<p>EZTrack offers the following services:<\/p>\n<ul>\n    <li>Reception and storage of GPS data transmitted by the beacons\/trackers of the Client's vehicles;<\/li>\n    <li>Automatic calculation of kilometers travelled per vehicle and per journey;<\/li>\n    <li>Map visualization of routes (OpenStreetMap maps);<\/li>\n    <li>Generation of PDF reports (per trip, per vehicle, monthly);<\/li>\n    <li>Generation of PDF reports (per trip, per vehicle, monthly);<\/li>\n    <li>REST API access for GPS data integration (depending on the subscription plan).<\/li>\n<\/ul>\n\n<h2>Article 4 \u2014 Formulas and prices<\/h2>\n<p>EZTrack offers several subscription plans, the details of which (price, included features, limits) are described on the pricing page of the eztrack-vehicule.com website.<\/p>\n<p>Prices are shown in euros excluding tax (HT). The applicable VAT will be added at the rate in effect at the time of invoicing. <\/p>\n<p>EZTrack reserves the right to modify its prices. Any changes will be communicated to the Customer at least 30 days before they take effect. In case of disagreement, the Customer may cancel their subscription in accordance with Article 8.  <\/p>\n\n<h2>Article 5 \u2014 Payment Terms<\/h2>\n<ul>\n    <li>Subscriptions are billed monthly or annually depending on the customer's choice.<\/li>\n    <li>Payment is made by credit card or direct debit via the secure payment platform provided.<\/li>\n    <li>In the event of late payment, late payment penalties will be applied at the prevailing legal rate, without the need for a reminder.<\/li>\n    <li>In the event of non-payment within 15 days after a reminder, EZTrack reserves the right to suspend access to the services.<\/li>\n<\/ul>\n\n<h2>Article 6 \u2014 Duration and Renewal<\/h2>\n<p>The subscription takes effect on the date of purchase for the chosen duration (monthly or annual). It is automatically renewed for the same period unless terminated by either party. <\/p>\n\n<h2>Article 7 \u2014 Trial Period<\/h2>\n<p>EZTrack may offer a free trial period. At the end of this period, the subscription will automatically convert to a paid plan unless the customer cancels before the end of the trial period. No charges will be made during the trial period.  <\/p>\n\n<h2>Article 8 \u2014 Termination<\/h2>\n<ul>\n    <li>By the Customer: The Customer may cancel their subscription at any time from their customer account or by email to contact@eztrack-vehicule.com. Cancellation takes effect at the end of the current billing period. No pro-rata refund will be issued.  <\/li>\n    <li>By EZTrack: EZTrack reserves the right to terminate the subscription in the event of a serious breach by the Client of these Terms and Conditions, in particular in the event of non-payment, fraudulent use or violation of the terms of use.<\/li>\n<\/ul>\n<p>In the event of termination, the Client may retrieve their data within 30 days of the effective termination date, in CSV or JSON format. After this period, the data will be deleted. <\/p>\n\n<h2>Article 9 \u2014 Client Obligations<\/h2>\n<p>The Client agrees to:<\/p>\n<ul>\n    <li>Use the services in accordance with their intended purpose and applicable legislation;<\/li>\n    <li>Ensure that GPS tracking of vehicles is carried out in compliance with labor law and privacy laws, in particular by informing the drivers concerned;<\/li>\n    <li>Do not attempt to circumvent the technical limitations of the subscribed formula;<\/li>\n    <li>Maintain the confidentiality of your login credentials and API keys;<\/li>\n    <li>Do not use the services for illegal purposes or in a way that infringes on the rights of third parties.<\/li>\n<\/ul>\n\n<h2>Article 10 \u2014 Obligations of EZTrack<\/h2>\n<p>EZTrack is committed to:<\/p>\n<ul>\n    <li>To provide a service that conforms to the description of the subscribed plans;<\/li>\n    <li>Ensure platform availability with a target of 99.5% monthly availability (excluding scheduled maintenance);<\/li>\n    <li>Inform the Client of any scheduled maintenance at least 48 hours in advance;<\/li>\n    <li>Ensure the security and confidentiality of Client data.<\/li>\n<\/ul>\n\n<h2>Article 11 \u2014 Protection of personal data<\/h2>\n<p>EZTrack collects and processes personal data in the context of providing its services, in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.<\/p>\n<ul>\n    <li><strong>Data collected<\/strong>: Customer contact details (name, email, telephone), GPS data of vehicles (latitude, longitude, timestamp, speed).<\/li>\n    <li>Purpose: provision of GPS tracking service, billing, technical support.<\/li>\n    <li><strong>Retention period<\/strong>: data is kept for the duration of the contract and 12 months after termination, unless otherwise required by law.<\/li>\n    <li>Subcontractor: EZTrack acts as a data processor within the meaning of the GDPR for the GPS data collected. The Client remains responsible for the processing with respect to the data subjects (drivers). <\/li>\n    <li>Rights: The Client and data subjects have the right to access, rectify, erase, port, and object to the processing of their personal data. These rights can be exercised by emailing <a href=\"https:\/\/eztrack-vehicule.com\/en\/contact\/\">contact<\/a>. <\/li>\n<\/ul>\n\n<h2>Article 12 \u2014 Intellectual Property<\/h2>\n<p>The EZTrack solution, its software components, interface, documentation, and content are the exclusive property of EZWAY TECHNOLOGY. The Client benefits from a non-exclusive, non-transferable right of use, limited to the duration of the subscription. <\/p>\n<p>The GPS data transmitted by the Client remains the property of the Client.<\/p>\n\n<h2>Article 13 \u2014 Responsibility<\/h2>\n<ul>\n    <li>EZTrack cannot be held liable for indirect damages (loss of revenue, loss of data, damage to image) resulting from the use or inability to use the service.<\/li>\n    <li>EZTrack's liability is limited to the total amount paid by the Client during the last 12 months.<\/li>\n    <li>EZTrack cannot be held responsible for the inaccuracy of GPS data transmitted by the Client's beacons\/trackers.<\/li>\n    <li>EZTrack cannot be held responsible in the event of force majeure (network failure, natural disaster, government decision, etc.).<\/li>\n<\/ul>\n\n<h2>Article 14 \u2014 Service Level Agreement (SLA)<\/h2>\n<p>EZTrack guarantees a monthly uptime of 99.5%. If this is not met, the Customer may request a credit note corresponding to: <\/p>\n<ul>\n    <li>Availability between 99% and 99.5%: credit of 10% of the monthly amount;<\/li>\n    <li>Availability between 95% and 99%: credit of 25% of the monthly amount;<\/li>\n    <li>Availability less than 95%: credit of 50% of the monthly amount.<\/li>\n<\/ul>\n<p>Scheduled maintenance and force majeure events are excluded from the availability calculation.<\/p>\n\n<h2>Article 15 \u2014 Technical support<\/h2>\n<p>EZTrack provides technical support via email. Response time depends on the subscription plan: <\/p>\n<ul>\n    <li>Starter package: email support, response within 48 working hours;<\/li>\n    <li><strong>Pro package<\/strong>: priority support, response within 24 business hours;<\/li>\n    <li>Business package: dedicated support, response within 4 business hours.<\/li>\n<\/ul>\n\n<h2>Article 16 \u2014 Right of withdrawal<\/h2>\n<p>In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium where performance has begun with the consumer's agreement.<\/p>\n<p>However, EZTrack offers a 14-day \"money-back guarantee\" from the date of your first paid subscription. A full refund will be issued upon request via email. <\/p>\n\n<h2>Article 17 \u2014 Applicable Law and Jurisdiction<\/h2>\n<p>These Terms and Conditions are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution.
